Pursuit Zen Terms of Use

These Terms of Use ("Agreement") govern your access and use of Pursuit Zen ("Application") provided by Table Four Technologies Inc. ("Company"). By accessing or using the Application, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, please do not use the Application.

1. Application Description

The Application leverages artificial intelligence models, including but not limited to Language Model Models (LLMs) provided by Microsoft Azure, to manage the pursuit process including generating written content for use in preparing sales proposals for construction contract opportunities. The Application uses customer data as context to generate content.

2. User Types

The Application offers three user types with varying levels of access:

• Contributors: Limited access, can make changes to content and add/complete tasks.

• Managers: Access includes all Contributor privileges, plus the ability to upload documents, manage the document library, and create/manage pursuits.

• Administrators: Access includes all Manager privileges, with additional abilities to add or remove users and handle billing functions.

3. Data Privacy

Customer data is collected and stored on company servers solely for the purpose of providing the service. The Company does not use customer data for any other commercial purposes. Data is siloed and is not shared between customers.

• are NOT available to other customers.
• are NOT used to improve any Microsoft or 3rd party products or services.
• are NOT used for automatically improving Pursuit Zen controlled models.

4. Subscription Models

There are two subscription models available: month-to-month and annual. Users can choose the subscription plan that best suits their needs. Users may switch from month-to-month to annual at any time, or from annual to month-to-month at the end of the Customer Agreement period.

5. Ownership of Content

Content provided by the customer and content generated by the Application belong entirely to the client. The client represents that their content does not violate any applicable laws or the terms of use.

6. Third-Party Services

The Application utilizes LLMs and other services provided by Microsoft Azure.  Data is shared with Microsoft Azure insofar as it is required to provide the service.  Data privacy is maintained in this process.  

7. Limitation of Liability

The Company's liability is limited to the lesser of $1,000 or one month of the contract amount.

8. Usage of Generated Content

Customers are free to use the content generated by the Application for any purpose, as it belongs to them. Customers may grant access to individual users of the Application as they see fit, provided that fees for users are paid for as per the Customer Agreement.

9. Termination and Deletion of Data

Users can terminate their contract with 30 days' notice. Upon termination, the user's account will be deactivated, and users will not be able to log in. Customer data will be deleted from the Application at that time.

Refund Policy: Please note that there will be no refunds for any remaining subscription period if a customer chooses to terminate their contract before the end of the current billing cycle. The termination will take effect at the end of the notice period, and the customer will not be billed for any subsequent billing cycles.

10. Company Updates

Users may, at their sole discretion, subscribe to the Company's update newsletter. This newsletter will inform users of material changes to both the Application and the Terms of Use.

11. Compliance

There are no industry-specific regulations or compliance requirements associated with the use of the Application.

12. Governing Law

This Agreement is governed by and construed in accordance with the laws of Alberta, Canada.
